It might be something you can take up with the dealership ... when I purchased my FEH, the sales person went to great lengths explaining to my why I should never loose my keys, as they were coded to the car.
IANAL but, IMHO, this constitutes a verbal contract ... and if the car does NOT have the function described, then they are in violation of that contract.
Of course, I could be wrong.
