Like I said before Jason, you don't own the copyright. So your New York Times example doesn't apply. The copyright belongs to the original authors, and apparently they don't care.

Eventually though, mixedpower.com will make a mistake and publish an article where the author DOES care, and they'll find themselves with a lawsuit (or a cease-and-desist letter).
