Sounds like you are advocating insurance fraud, CA Girl. He said nobody was hurt and regardless of fault, that doesn't give anyone the right to sue for "pain and suffering" that doesn't exist.
Sue the owner/driver of the Tbird for the lost value of your car if you are able, but don't make up injuries where none exist.

Hope you're not a AAA policy holder or employee... What got me rankled is the fact that the girl,her father, and AAA tried to blame my wife for causing the accident.. After seeing the police report they have since changed their "tune".. If they had owned up to their responsibility I wouldn't have had to get our insurance co. involved... Geico has done an excellent job, they paid for the Escape repairs, minus our deductible, on the spot at the Ford dealer... and they, as I will have to collect from AAA for that part.. By the way, we got a great deal on an 08 Camry Hybrid, and will have to sell the Escape at a diminished value, even our Ford dealer didn't want it on their lot...and they're fixing it... So we'll probably have to sue AAA for that and rental car fees,extra gas, one dr. visit (some "soft tissue" bruising, finger tingling), lost sleep, aggravation, lost work hrs... All because they decided to shirk their responsibility.. and now they've turned me into a "Hockey" player, and as Jim Carey said recently on Letterman, "hockey players want vengeance..."
We'll see what happens, good thing I'm self employed, so I can devote an
hr a day it takes to deal with this mess..

IMO, It is their policy. My wife was forced off the road and into a rollover in my son's Audi when a truck changed lanes from the inside to the far right lane. AAA insured the truck, and in the first week they tried to accuse my wife, who is a non-drinker of fifty years, won't take drugs short of dying and gets drunk on a wine cork, of driving drunk. They tried to claim she just drove off the road and that there was no truck. (The field agent's actual words were a "phantom truck".) Fortunately there was a witness, and they got the license number and vehcile colors. Even then our insurance had to pay everthing initially under Uninsured Motorist terms, and then go after AAA. PEMCO is pretty good, so we never heard if they recoverd anything from them or not.

several years ago my 88 jeep grand wagoneer got t-boned at 20 miles per hour by a blue-haired old lady driving a new (dealer tags) caddy. her car was crushed from the windshield forward. mine needed a door. there is something to be said for 5000 pounds of american steel...

Fastmover and group,
I was a mild mannered self employed home remodeler, but after this experience I morphed into the "Hockey player bent on revenge".. After this is all said and done, and if I morph back to my former self I think a song may pop out of this.. And when you play it backwards the sun will come out my old dog
will live again and I'll be driving a Lotus-Zap E-car....needs lots of work but Hockey players aren't usually known for their wit or lyrical ability...

I am neither but it wouldn't matter anyway. My point (to CA Girl) was that suing for pain and suffering (when in your first post you stated that noone was hurt) would be fraudulent. Suing them for the diminished value of your vehicle would not be and would be very appropriate.

In my normal job, I work as a Fleet Manager and we are self-insured. We end up with a lot of cars in bad shape due to wrecks 50/50 my guys fault. Generally for our cars, we get 3 quotes and then repair the vehicle and then our Risk Management go to the insurance company.
That is all said, our criteria for not repairing the car is based on several factors. If the unibody frame is bent in any way, it is almost an automatic total. The reaoning here is that it is next to impossibile to ever get it straight and the car will always have alignment and probably turtle walk down the interstate.
The second option we look at is what is the blue book value and then 70% versus the repair of the car. This seems to be okay with the insurance companies.
Anyhow, not sure if my experiences will help you, but hope so. I like my 08, sort of wish I had an 09 now. But I always like toys. The other thing I regret, was getting the Nav System. I would had taken Scan Gauge and put in after-market Nav with options. Am I unhappy with the truck, not in anyway.

We got the car back friday, looks great... paint
is a perfect match... Door fit is ok, I would like
closer tolerances, I am a finish carpenter, and notice
even slight differences.compared from side to side..
Overall it will probably end up a B+.. The Ford dealer
tried to put only one new tire on and it wasn't a EcoPlus.
their tire supplier "said" they weren't available... Next
morning I found 2 within 10 miles in 5 minutes on the phone. I had to talk
my adjuster into 2 tires, for uniform wear... Also, dealer tried to pass the damaged wheel, with a flat spot and a new silver paint job off as a "remanufactured" wheel... Car drives like before, tracks and brakes straight..
There were quite a few parts replaced over 30 I think, more than $3500..
Labor was over $5500.. All paid for by my insurance co. and us.. Hopefully
recovered from AAA, who is paying for the rental car.. The FEH is now up for sale, anybody have an idea what they are going for repaired or original with 20K miles, leather upgrade package..
Next chapter/verse: negotiations with the evil AAA empire... I've already talked 3 of their insureds into new insurance with the nicer/gentler Geico..

Are you selling your car only because it was in a major wreck and has been repaired? If the repairs were done correctly, if the car runs and drives right and it looks as good as new, then why not keep it and avoid the loss of value? You still have the remainder of the warranty and since it was repaired by a dealer (IIRC) then there should be no problem with them standing behind the car if it ever turns out that there are electrical or drivetrain issues related to the accident.
As the car gets older and gets more miles on it (and would naturally have lower value), the impact of the major collision repair will be less and less.
But if you decide to sell it, good luck and hope you get a good price.
