CARS Program New Guidance and Ordering a 2010 FEH
I have been interested in getting a FEH through the Clunker (CARS) program to replace my Jeep ZJ, but was frustrated by the lack of selection (only 2009 model year on the dealer lots) and the sudden increase of the price to MSRP (supply versus demand). I really wanted the 2010 model year and at a reasonable price. I was resigned to the expectation that even with the $2 billion infusion, the CARS program would wrap up by the time the 2010 FEH models arrived at the dealers for an attempt at bargaining.
I remained patient and lined up all my ducks (paperwork prep, clunker prep, FEH research) ready to pull the trigger. I continued to observe that the 2009 models were being cleared off the dealer lots by the program.
Then, as of Fri 14-Aug-2009:
In addition, on Sat 15-Aug-2009, I got a call back from a dealer (the owner, no less) in reply to an Edmunds e-mail contact I tried during the FEH research that had since gone stale. This Ford dealer was gearing up to capitalize on the new rule. Looks like Ford (corporate) is ramping up the FEH production line and order pipeline for the added demand and new CARS guidance.
PLUS, this dealer has a FLEET sales business model. Only a reasonable assessment added to the listed invoice price (confirmed on Edmunds). PLUS, CA law protects on deposits for orders. If I am not happy, one could always walk away. But the deal is GREAT!
Fleet pricing, Clunkers credit, Sales Tax deduction, Hybrid credit (hopefully okay for 2010 model year).
So, I pulled the trigger, ordering a 2010 FEH on Sun 16-Aug-2009 with a "deposit" which was placed in the Ford order bank on Mon 17-Aug-2009.
I'll have to see what time brings. I hope the paperwork processing and delivery are timely. The dealer seems motivated to make this happen. If you are in the SF Bay Area, I can highly recommend him.

In response to overwhelming interest in the CARS program, NHTSA has clarified that consumers who want to purchase new vehicles not yet on dealer lots can still be eligible for the CARS program. Dealers and consumers who have reached a valid purchase and sale agreement on a vehicle already in the production pipeline will be able to work with the manufacturer to receive the documentation needed to qualify for the program.

FYI: Secretary LaHood announces wind down to hugely popular CARS program
U.S. Transportation Secretary Ray LaHood announced Thursday that after a wildly successful run, the cash for clunkers program will come to a close on Monday, August 24th at 8 p.m. EST.
